Joshua A. Levy is a founding principal of Cunningham Levy Muse LLP, a premier Washington DC litigation and investigations boutique law firm. Mr. Levy is one of the nation’s top white-collar defense attorneys and civil litigators. Mr. Levy’s expertise includes the representation of clients from around the world caught up in high-profile, high-stakes, Washington-based inquiries emanating from congressional committees, grand juries, federal enforcement agencies and/or civil litigation, often simultaneously.

Congressional Investigations: Levy has represented dozens of companies, non-profits and individuals before congressional oversight and investigations committees, including but not limited to examinations of the 2016 U.S. Presidential election, the Benghazi attacks, Operation Fast and Furious, the financial collapse of 2008, and private security contractors in Afghanistan. Mr. Levy served as counsel to two U.S. Senators and the U.S. Committee on Homeland Security and Governmental Affairs, where he investigated government responses to Hurricane Katrina and the state of U.S. transit security following the 2005 London Underground bombings. He has taught “Congressional Investigations” at Georgetown Law since 2008.
White Collar Criminal Defense: Levy defends companies, non-profits and individuals under investigation by grand juries, federal law-enforcement agencies and U.S. Attorney’s Offices. He also conducts internal investigations on behalf of companies, sovereigns and non-profits seeking responsible, outside legal counsel with regard to internal allegations. He has represented clients under investigation for a wide variety of alleged criminal activity, including:
Health Care Fraud: Doctors, hospitals, pharmaceutical companies, medical device manufacturers and their employees must comply with a variety of federal, state and local laws, such as the False Claims Act, the Anti-Kickback Statute, the Stark Laws and the Food, Drug & Cosmetics Act. Health care fraud investigations often begin with a sealed civil complaint under the False Claims Act and can grow into civil, administrative and criminal investigations. Mr. Levy advises companies and individuals on their compliance with these statutes and represents them when under investigation. On his clients’ behalf, Mr. Levy has helped persuade the Justice Department not to charge or indict several health care executives and other health care professionals. He has taught “Health Care Fraud and Abuse” at Georgetown Law, since 2012.
Public Integrity: The Department of Justice and U.S. Attorney’s Offices investigate and prosecute public officials for alleged corruption and criminal abuse of the nation’s honest services fraud, campaign finance, conflict-of-interest and domestic anti-bribery laws. Mr. Levy has represented non-profits and individuals in such matters. In none of these representations did the government charge or indict any of Mr. Levy’s clients
Bribery of Foreign Officials: Levy has represented and advised a variety of companies and individuals with regard to compliance with the Foreign Corrupt Practices Act (“FCPA”). He has conducted FCPA internal investigations on behalf of companies, represented them in government investigations and has assisted with pre-merger due diligence, evaluating any exposure under the FCPA for parent corporations. He also creates FCPA compliance programs and trains employees on compliance with the statute and other US and international anti-bribery laws.
Export Control: Levy has represented companies and individuals under investigation for violating U.S. export control law, and he has helped companies conduct internal investigations into allegations of such violations.
Representation of Government Officials: Both career employees of the federal government and political appointees can find themselves under investigation by Inspectors General, the Office of Special Counsel and/or Congress for their conduct or performance on the job. Levy has represented government officials in such inquiries regarding high profile matters, such as the Benghazi attacks and Fast and Furious. In none of these representations did the Justice Department charge any of Mr. Levy’s clients.
Commercial Litigation: An experienced trial lawyer, Mr. Levy has represented numerous companies and individuals in litigation and arbitration. He has prosecuted and defended contract, business tort, civil RICO, among many other types of claims. Mr. Levy has represented relators in qui tam actions, including the relator in Thakur ex rel. United States v. Ranbaxy (D.Md.), which resulted in the U.S. government’s largest settlement with a generic drug company under the False Claims Act. He also represented dozens of clients who have received third party subpoenas in commercial litigation.
- Conducts an investigation, on behalf of the Government of Rwanda, into the role of French officials in the 1994 Genocide against the Tutsi.
- Represented Fusion GPS and its principals Glenn Simpson, Peter Fritsch and Tom Catan before congressional committees in their investigations into the 2016 U.S. Presidential election.
