With all the tangible and intangible costs associated with litigation today, mediation is becoming more common as a means of resolving disputes. Judges are ordering or at least recommending them, and contracts are stipulating them as part of their alternative dispute resolution clauses. As a result, good law schools around the country are including mediation and mediation advocacy courses in their curriculum, and many retired judges and lawyers are hanging out their shingles as they build their mediation practices.
Having mediated many disputes across a range of practice areas, I have noticed that many attorneys trained and experienced in litigation, do not necessarily have the skills to effectively negotiate, mediate or to guide their clients through the mediation process. This course is intended to provide attorneys with advanced knowledge and skills in negotiation and mediation, which will hopefully arm them with more arrows in their quiver to resolve disputes efficiently and effectively while preserving their client’s dignity and resources.
This course will be a skill-based course as opposed to information-based and will include role play simulations to demonstrate technique.
Raphael E. Lapin is a Harvard-trained negotiation, mediation, and communication specialist who serves as a negotiation consultant to Fortune 500 corporations and governments globally. He has demonstrably helped clients increase revenue and growth opportunity through optimized negotiation strategy. With his advanced and experienced dispute resolution skills, he has also saved both corporate clients and individuals the enormous costs of conflict and litigation. He is principal of Lapin Negotiation Services and Adjunct Professor of Law at Whittier School of Law where he is responsible for the negotiation and mediation programs. Raphael received his training at Harvard Law School and was accepted as one of only 24 candidates nationally to attend Harvard Law School’s Advanced Negotiation Program, which he completed in 1996.

ProLawCLE will seek approval of any CLE program where the registering attorney is primarily licensed with exceptions stated below. Application is made at the time an attorney registers for a course, therefore approval may not be received at the time of broadcasting.
