This CLE provides a summary of cases providing guidance for the use of machine learning in eDiscovery. Some within the legal industry refer to this as Technology-Assisted Review, TAR or Predictive Coding. Artificial intelligence tools are relied upon in the eDiscovery process, primarily for early case assessment to provide quick insights. AI is so crucial because it is practically impossible to review all the data manually since investigations regularly involve enormous quantities of data. Dave is the Practice Group Leader of Reed Smith’s Records & E-Discovery (RED) Practice Group and a member of the firm’s Global Leadership Team. He has more than 30 years of commercial litigation experience in a variety of subject matters. David serves as e-discovery counsel to multiple clients and also counsels clients on information governance and litigation readiness issues. He has also served as a court-appointed E-Discovery Special Master in multiple cases.

Philip Favro
Philip Favro is a Chambers-ranked lawyer who serves as a trusted advisor to organizations and law firms on issues relating to electronic discovery and information governance. Phil serves as a special master and an expert witness on cases involving electronic discovery issues. He also provides clients with guidance on data preservation practices, litigation holds, data collection strategies, and ESI search methodologies. Phil additionally offers direction on records retention policies, litigation hold policies, and the need to manage dynamic sources of information found on messaging applications and workplace collaboration tools.
