Intellectual Property Basics in the areas of Patent, Trademark and Copyright Law. We will cover the basics of acquiring, asserting and defending rights associated with the three dominant areas of intellectual property, Patent, Trademark & Copyright. We will also touch on the crossover between trademark law and domain names as well as provide information on the newly authorized (and developing) Copyright Small Claims Court that, currently, is scheduled to begin accepting cases in December 2021.

Mr. West formed West & Associates in February 2004. Mr. West is the managing patent attorney at West & Associates. Mr. West is responsible for coordinating prosecution, transactional and litigation matters. In addition to counseling clients in matters related to the litigation and licensing of intellectual property rights, Mr. West’s practice also includes counseling clients in obtaining, protecting and enforcing rights associated with patents, trademarks, service marks, trade names, trade secrets and copyrights before the Federal Courts, in State Courts and before the Trademark Trial and Appeal Board and the Board of Patent Appeals and Interferences.

Patent Law: we will cover the basics of patentability, the basic application process and the essentials of literal patent infringment--US Practice Only.

Copyright Law: we will cover the basics of Creation of a Copyright Interest, fundamentals of the work-for-hire doctrine, the registration process and completing the application, plus the basics of literal copyright infringement along with a high-level overview of Fair Use--US Practice Only.

Trademark Law: we will cover a basic overview of US Trademark law and the US concepts of Common Law Rights and Registered Rights. Additionally, we will cover the application process and the essentials of infringement. Finally, we will touch on the interplay of URLs and TM law--US Practice Only.
