With the current pandemic we are seeing more and more state action in an attempt to provide for public health. However few citizens – or lawyers – have gained an aware of state public health laws that often provide the state great power in the event of a pandemic or emergency. Many lawyers have been shocked to learn that their states have laws that allow the state the power to actually force vaccines upon persons in their territory. And many other states have laws that allow for quarantine or isolation. US Supreme Court rulings may uphold this power. As the pandemic continues we expect forced vaccine laws to become highly discussed among lawyers and the public. This CLE will get you an overview of these types of laws and what we have found so far around the US. Particular attention will be given to Florida’s forced vaccine law but other states will be discussed too.
