This recorded CLE webinar provides an overview of trade secret cases and how alternative dispute resolution (ADR) is used more frequently to resolve these matters effectively and efficiently. The enactment of the 2016 Defend Trade Secrets Act has led to an increase in litigation and given the potential for drawn out litigation, ADR can provide more assurance that the trade secret at issue and other confidential information will become public. ADR can also provide business solutions not typically available to the parties in the litigation process.

Hon. Elizabeth Laporte
Hon. Elizabeth D. Laporte (Ret.) joined JAMS after more than two decades as a United States magistrate judge for the Northern District of California. Judge Laporte was the chief United States magistrate judge for the Northern District of California from 2013 to 2015. As a magistrate judge, she presided over numerous civil cases with the parties’ consent, with a robust docket that included patent, trademark, copyright, business, class actions, employment, insurance, environmental, antitrust and civil rights litigation.
Patrick M. Ryan is one of the top trade secret lawyers in the United States, representing major companies on both the defense and plaintiff’s side. In May of 2019, Patrick obtained an $845 Million judgment for ASML in one of the largest trade secret victories in US history, resulting in the Bartko firm being ranked as Number 3 in the Top 100 Verdicts – published by The National Law Journal (June, 2019) – and having the highest ranked intellectual property victory in the United States.
