The legal implications of death affect attorneys in all types of practice areas, especially those working in the fields of real estate, family law, estate planning, or business planning. Clients often ask attorneys in these fields questions such as, how will their family will receive their assets after they die? How their family receive their assets if they own real estate in other states? What happens to the client's business if one of the business owners dies? Should they follow Suze Orman's advice and create a revocable living trust? Attorneys viewing this presentation can expect to learn the answer to these questions, and more, with an easily-digestible snapshot of the probate process.
The term 'probate' comes from the Latin probatus meaning "to make good, esteem, make credible, or inspect." The probate process is the legal court process that is sometimes required in order to transfer assets to an individual's beneficiaries after the individual's death. This presentation breaks the analysis of probate into three main parts, namely (i) determining whether probate is necessary and what forms it takes, (ii) looking at the procedural steps of the probate process, and (iii) resolving disputes within the context of a probate proceeding.
